The Swiss market

Swiss clients demand exactness and restraint to a particular degree. A proposal that answers the data protection question only in European terms is read as incomplete, because Switzerland is precisely not in the Union.

For Swiss clients we deliver multilingually, frequently in German, French and Italian, and design the data protection position for the Swiss legal order from the outset.

Data protection on its own terms

Swiss data protection runs under the revised Federal Act on Data Protection, with the Federal Data Protection and Information Commissioner as supervisor. Transfers from Switzerland to third countries require Swiss-specific safeguards that an EU package does not cover. We work with your legal advisers on this from the outset and have the position reviewed before contracting.

The financial sector

For Swiss financial institutions there is an additional layer: FINMA's outsourcing expectations and the treatment of client identifying data under Swiss banking secrecy, which places specific requirements on outsourcing that a German or Austrian client does not face. We design for these on their own terms and not as an annex to a European solution.

Currency and contract

Proposals and pricing for the Swiss market are stated in Swiss francs. The contracting structure follows the Swiss legal position, and the data protection and transfer documentation is oriented to the expectations of the Swiss supervisor rather than translated from an EU package.
